Employer of Record

The Employer of Record for casual work.

An Employer of Record (EOR) is a company that legally employs workers on behalf of the business they work for, carrying payroll, tax, superannuation, and compliance while the business directs the work. MyGig is the authorised Employer of Record for casual workers in NSW, WA, TAS and NT.

Most EOR providers exist so companies can hire salaried staff across borders. MyGig applies the model to the hardest employment problem in Australia: casual, shift-based work, where every hour has to be priced against the correct Modern Award. You book vetted workers shift by shift; MyGig employs them, pays them the next day, and carries the compliance.

Operating credentials

What MyGig carries as the Employer of Record

Employment contracts

Every worker is employed by MyGig Workforce Pty Ltd under compliant casual contracts - no ABN sham-contracting arrangements, ever.

Award-correct payroll

Every hour is priced against the correct Modern Award with the clause cited - base rate, casual loading, penalties, overtime - by the engine covering 118 awards.

PAYG, super, workers comp

Tax withholding, 12% superannuation paid with wages, and workers compensation cover all sit with MyGig, not with your business.

Next-day worker pay

Workers are paid the day after every shift at no cost to them - the single biggest reason good workers keep choosing your shifts.

Fair Work compliance

Award interpretation, payslips, record-keeping, and entitlements are handled end to end. See the compliance page for how the engine works.

One invoice, flat 15%

You get one invoice per day of shifts and pay a flat, published 15% service fee on wages and on-costs. The estimate shows before you book.

Moving an existing casual workforce onto MyGig? That’s a workforce transfer - we onboard your incumbent workers as MyGig employees with no gap in their shifts. Payroll-first questions live on payroll outsourcing and daily payroll.

EOR, PEO, or an agency?

All three put someone between you and the worker, and they are routinely confused. The difference that matters is who is legally the employer, because that is who carries an underpayment claim.

What stays with you

Handing over employment is not handing over your operation. The split is cleaner than most people expect.

You direct the work

What gets done, when, to what standard, and by whom. You choose the individual workers from their profiles and keep the ones you like in a Pool so they see your shifts first.

You control the site

Induction, supervision and safe systems of work stay with the business that controls the workplace. Work health and safety follows the workplace, not the payslip, so agree who inducts and how incidents are reported before the first shift.

MyGig carries the employment

The contract, payroll, PAYG, 12% superannuation, workers compensation and award interpretation. If a rate is questioned, the obligation is ours and the clause-cited record is what answers it.

Nobody is locked in

No minimum, no term, no notice period. Book one shift a month or a thousand, and if you later hire someone permanently there is no transfer fee.

EOR questions, answered plainly

What does EOR stand for?

EOR stands for Employer of Record: a company that legally employs workers on behalf of the business they work for, carrying payroll, tax withholding, superannuation, workers compensation, and employment-law compliance while the client business directs the day-to-day work.

What is the difference between an EOR and a PEO?

An Employer of Record becomes the sole legal employer of the workers, so employment risk and obligations sit fully with it. A PEO (professional employer organisation) co-employs staff alongside your business, which leaves part of the employment obligation with you. MyGig operates as a full EOR: the workers on your shifts are employed by MyGig Workforce Pty Ltd, not by your business.

Who is the employer when I book workers through MyGig?

MyGig Workforce Pty Ltd (ABN 20 692 462 856) is the Employer of Record. Employment contracts, payroll, PAYG withholding, 12% superannuation, workers compensation, and Modern Award compliance sit with MyGig - your business books the shifts and pays one invoice.

Where does MyGig operate as an Employer of Record?

MyGig operates as the authorised Employer of Record in NSW, WA, TAS and NT, with Victoria and Queensland launches planned for 2027. See the locations page for every market, live and upcoming.

Is an Employer of Record legal in Australia?

Yes. The arrangement is that one business legally employs a worker and supplies them to work under another business’s direction, which is a long-established model in Australian employment. What matters is that the employer genuinely carries the obligations: a real employment contract, PAYG withholding, superannuation, workers compensation and correct award rates. MyGig carries all of those, and the relevant state requirements are covered wherever we operate.

Do we lose control of the workers?

No. You direct the work: what gets done, when, to what standard, and by whom. You pick the individual workers from their profiles and keep the ones you like in a Pool so they see your shifts first. What moves to MyGig is the employment itself, not the management of the job.

How quickly can we start?

Same day. There is no onboarding project, no implementation fee and no minimum: sign up, post a shift, and vetted workers who are already MyGig employees can accept it. Moving an existing casual workforce across takes longer because entitlements need a proper handover, and we work through that case by case.

What does MyGig’s EOR service cost?

One flat 15% service fee on wages and on-costs (super, workers comp, payroll tax). There are no setup fees, placement fees, or monthly minimums, and the full cost estimate is shown before you book each shift.

Compare the model against your current costs with the Savings Calculator, or see where we operate on the locations page.
